This Privacy Policy explains how Darmik Software Solutions Inc. d/b/a EZdine59.com (“EZdine59.com,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when individuals visit our websites, communicate with us, use our software or services, place orders through websites or online-ordering experiences powered by EZdine59.com, receive marketing communications facilitated by our Services, apply for employment through EZhire, or otherwise interact with services that link to this Privacy Policy (collectively, the “Services”).

 

This Policy applies to information EZdine59.com processes for its own business purposes and, where described below, to information we process on behalf of our business clients. A restaurant or other business using EZdine59.com may have its own privacy policy and may independently determine how it uses customer, applicant, or other personal information. When EZdine59.com processes personal information solely on behalf of a Client, the Client’s instructions and applicable agreement with EZdine59.com govern that processing.


1. Information We Collect

We collect information that you provide directly, information generated through your use of the Services, and information received from Clients, service providers, integrations, and other lawful sources.

  • Contact and account information, such as name, business name, job title, mailing address, email address, telephone number, username, account identifiers, and authentication information.
  • Business and restaurant information, such as locations, hours, menus, products, pricing, photographs, logos, promotions, social-media information, POS information, merchant or processor information, and account configuration.
  • Order and transaction information, such as items ordered, order totals, pickup or delivery details, transaction status, refunds, and related customer-service information. Payment-card data may be collected and processed by our payment-processing providers; EZdine59.com may receive tokens, transaction identifiers, limited card details, and payment status rather than full card numbers.
  • Customer and marketing information, such as email addresses, mobile numbers, communication preferences, loyalty information, campaign activity, and consent or opt-out records.
  • Applicant and recruiting information submitted through EZhire, such as contact information, employment history, qualifications, application responses, interview information, and communications with a prospective employer.
  • Communications and support information, including emails, messages, support requests, call notes, survey responses, and other information you choose to provide.
  • Device, usage, and log information, such as IP address, browser type, device type, operating system, referring pages, pages viewed, timestamps, approximate location derived from IP address, diagnostic data, and interactions with the Services.
  • Cookie and similar-technology information used for authentication, preferences, analytics, security, functionality, and, where applicable, advertising or measurement.
  • Information from integrations and third parties, including POS providers, payment processors, delivery providers, social networks, review platforms, communications providers, analytics providers, and other services connected at the Client’s direction.

 

2. How We Use Information

We may use personal information for the following business and commercial purposes:

  • Provide, operate, configure, maintain, support, and improve the Services.
  • Create and administer accounts, authenticate users, provide customer support, and communicate about service or account matters.
  • Build and maintain websites, online-ordering experiences, menus, integrations, marketing tools, social-media functionality, reputation-management tools, text-marketing functionality, and EZhire.
  • Receive, route, manage, and support restaurant orders and related transactions.
  • Facilitate payment processing, billing, subscription administration, fraud prevention, refunds, disputes, and chargebacks.
  • Provide requested marketing and communications functionality, including email or text communications when permitted by applicable law and the recipient’s choices.
  • Provide recruiting and applicant-management functionality for Clients using EZhire.
  • Analyze performance, troubleshoot problems, monitor availability, secure the Services, prevent abuse, and detect fraud or unauthorized activity.
  • Develop, test, and improve our products, automation, analytics, artificial-intelligence features, and service quality.
  • Create aggregated or de-identified information that does not reasonably identify an individual.
  • Comply with law, enforce agreements, protect rights and safety, establish or defend legal claims, and respond to lawful requests.
  • Send information about EZdine59.com products or services where permitted by law. Recipients may opt out of promotional communications as described below.

 

3. Our Role When Processing Information for Clients

Businesses using EZdine59.com may collect personal information from their customers, applicants, employees, or other individuals through the Services. In many of these circumstances, the Client determines why and how the information will be used, and EZdine59.com processes the information to provide the contracted Services.

 

If you have a question or request concerning information controlled by a restaurant, employer, or other EZdine59.com Client, you should generally contact that business directly. We will assist Clients with appropriate privacy requests as required by applicable law and our agreements.

 

4. How We Disclose Information

We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described in this Policy:

  • EZdine59.com Clients, such as the restaurant receiving an online order or the employer receiving an EZhire application.
  • Service providers and contractors that provide hosting, cloud infrastructure, payment processing, communications, analytics, customer support, cybersecurity, data storage, artificial-intelligence technology, and other operational services.
  • Integration partners and third-party platforms selected or authorized by a Client, including POS systems, payment processors, delivery providers, social networks, review platforms, telecommunications providers, and related technology providers.
  • Professional advisers, auditors, insurers, financing sources, and other advisers subject to appropriate confidentiality obligations.
  • Government authorities, regulators, courts, law enforcement, or other parties when disclosure is required or permitted by law or reasonably necessary to protect rights, safety, security, or property.
  • A purchaser, investor, successor, lender, or other relevant party in connection with a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, due diligence process, or similar corporate transaction, subject to appropriate protections.

 

5. Sale, Sharing, and Targeted Advertising

EZdine59.com does not sell personal information for money in the ordinary meaning of the word “sell.” Certain privacy laws may define “sale,” “sharing,” or “targeted advertising” more broadly to include some disclosures involving advertising, analytics, or cross-context behavioral advertising.

7. Payment Information

Payments may be processed by third-party payment processors. Depending on the transaction and integration, payment-card information may be entered directly into a processor-controlled environment rather than stored by EZdine59.com. Payment processors handle information according to their own terms and privacy policies.

 

EZdine59.com may receive transaction identifiers, tokens, payment status, limited payment-method information, billing details, and other information needed to administer transactions, subscriptions, refunds, disputes, and account support.

 

8. Text Messages and Marketing Communications

Where the Services support text or email marketing, messages may be sent by or on behalf of an EZdine59.com Client. The Client is responsible for having any consent required for its marketing communications and for complying with applicable marketing and telecommunications laws.

 

You may opt out of promotional email from EZdine59.com by using the unsubscribe mechanism in the message. For text messages, follow the opt-out instructions provided in the message, such as replying STOP where supported. Service, transactional, security, or account communications may still be sent when permitted by law.

 

9. EZhire and Applicant Information

EZhire enables businesses to receive and manage job applications and applicant communications. The prospective employer, not EZdine59.com, makes hiring and employment decisions and generally determines the purposes for which applicant information is used.

 

Applicants should contact the applicable employer regarding hiring decisions or employer-specific privacy practices. EZdine59.com may process applicant information to provide, secure, support, and improve EZhire and as otherwise permitted by our agreement with the Client and applicable law.

 

10. Artificial Intelligence and Automated Features

Some EZdine59.com Services may use artificial intelligence, machine learning, automation, or third-party AI technology to assist with content creation, communications, analytics, recommendations, review responses, marketing, recruiting workflows, or other functionality.

 

We may process information submitted to these features to provide the requested functionality, maintain security, evaluate performance, and improve the Services, subject to our agreements and applicable law. We do not represent that AI-generated output is always accurate or complete. Clients and users are responsible for reviewing output before relying on or publishing it where appropriate.

 

EZdine59.com does not use EZhire to make final employment decisions on behalf of a Client.

 

11. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain business and transaction records, comply with legal, tax, accounting, and regulatory requirements, resolve disputes, enforce agreements, maintain security, prevent fraud, and fulfill the purposes described in this Policy.

 

Retention periods vary depending on the type of information, the relationship with the Client or individual, contractual requirements, legal obligations, and operational needs. We may retain aggregated or de-identified information for longer periods where permitted by law.

 

12. Security

EZdine59.com uses administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. No internet transmission, storage system, or security measure can guarantee absolute security.

 

Clients and users are responsible for protecting their credentials, using appropriate access controls, and promptly notifying EZdine59.com if they believe an account has been compromised.

 

13. Privacy Rights and Choices

Depending on where you reside and applicable law, you may have rights concerning your personal information. These may include rights to request access to or confirmation of personal information, correction of inaccurate information, deletion, portability, or information about certain disclosures; to opt out of certain sales, sharing, targeted advertising, or profiling; to withdraw consent where processing is based on consent; and to appeal certain decisions concerning a privacy request.

 

These rights are not absolute and may be subject to verification, exceptions, and limitations under applicable law. We will not unlawfully discriminate against an individual for exercising an applicable privacy right.

 

To submit a privacy request concerning information for which EZdine59.com is responsible, contact us using the information in Section 20. We may need to verify your identity and authority before completing a request. Authorized agents may submit requests where permitted by law, subject to appropriate verification.

 

If your request concerns information controlled by an EZdine59.com Client, such as a restaurant order, loyalty account, marketing list, or job application, we may direct you to that Client or process the request on the Client’s instructions.

 

14. Do Not Track and Browser-Based Preference Signals

Some browsers provide “Do Not Track” signals. Because there is not a uniform industry standard for responding to all such signals, our response may vary. Where applicable law requires recognition of a legally valid browser-based opt-out preference signal, such as a qualifying universal opt-out mechanism, we will process that signal as required by law.

 

15. Children’s Privacy

The EZdine59.com business Services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 through Services directed to the general public. If we learn that we collected such information in a manner not permitted by law, we will take appropriate steps to delete or otherwise address it.

 

Restaurants and other Clients are responsible for ensuring that their own use of the Services, including loyalty, marketing, ordering, and employment-related activities, complies with laws applicable to minors.

 

16. Third-Party Websites and Services

The Services may link to or integrate with third-party websites, applications, payment processors, POS providers, delivery providers, social networks, review sites, or other services. Their privacy practices are governed by their own policies. EZdine59.com is not responsible for the privacy practices of third parties that independently control personal information.

 

17. Business Transfers

If EZdine59.com or Darmik Software Solutions Inc. is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to applicable law and appropriate protections.

 

18. International Processing

EZdine59.com and its service providers may process information in the United States and other locations where we or our providers operate. When applicable law requires safeguards for international transfers of personal information, we will use legally recognized transfer mechanisms or other appropriate protections.
